18 U.S.C. §2257 Record Keeping Requirements Compliance Statement - hotsex.tv

All models, actors, actresses and other persons that appear in any photograph or video, whether of actual or simulated sexual acts or otherwise, that is available on the website were over the age of eighteen years at the time of the creation of such.

Exemption: Content Produced by Third Parties

hotsex.tv is not a "producer" (primary or secondary) of any visual matter depicting real or simulated sexual behavior, explicit or otherwise, featured on the website. The operator of hotsex.tv restricts their activities with regard to sexually explicit content contributed by third-party users to transmission, storage, retrieval, hosting, or formatting only. All content that is provided by third-party users is displayed on areas of hotsex.tv which are under the control of those users. Consequently, the operators and owners of the website are exempt from compliance with Section 2257 records keeping and labeling obligations as laid out in 28 C.F.R. §75.1(c)(4). Any content on hotsex.tv that is determined to contravene the terms of use or other policies of the website will be removed by the operator without delay, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

Exemption: Content Produced by Website Operator

With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are excluded from compliance with the provisos of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit acts as specifically specified in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit acts created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.

Designated Records Custodian

The operator of the website has assigned a custodian to be the keeper of original records as necessitated by 18 U.S.C. § 2257 and 28 C.F.R. Part 75. The records are in the care of said custodian and can be examined by sending a request via our contact form.
